Terms and Conditions

1. General

The present terms and conditions of sale govern the relationship between Belfort Trading BV, having its registered office at Belfortstraat 33, B101, 9000 Gent, Belgium, hereinafter referred to as “the Vendor”, on the one hand, and any person or company ordering remotely (by means of placing an order online), for himself/herself or on behalf of a third party, for professional or private purposes, hereinafter referred to as “the Customer”, on the other hand.

Depending on the Customer’s specific position (consumer or otherwise), some clauses in these terms and conditions of sale may not apply.

Belfort Trading BV offers to sell products online through its website (hereinafter, the “Website”). The online store may be hosted by a third-party platform (e.g. Shopify or similar), which provides the e-commerce infrastructure enabling the sale of products and services.

2. Object

The products are described on the Website in good faith and as accurately as possible. The Customer may obtain additional information by contacting the Vendor via email.

The presentation of the products is not binding on the Vendor and does not constitute a legal offer.
Photographs, illustrations, or videos are non-contractual. The Vendor cannot be held liable for any errors in such representations.

3. Information

The Customer declares to have been fully informed of the characteristics of the products ordered and certifies:

  • To be at least 18 years old and legally competent;
  • Not to impersonate any person or entity or use false information;
  • To use the Website only in accordance with applicable laws;
  • To have accepted these Terms and Conditions and the Privacy Policy.

4. Orders

The products offered are those listed on the Website at the time of consultation, subject to availability.

Products (including perishable goods, where applicable) may not be subject to a right of withdrawal in accordance with applicable law.

Customers may create an account by providing accurate information. Login credentials remain personal and confidential.

Orders are finalized once the Customer clicks “Complete Order.” At that moment:

  • The order becomes binding;
  • Errors can no longer be corrected;
  • A confirmation email finalizes the contract.

The Vendor reserves the right to:

  • Refuse or cancel orders;
  • Request additional information;
  • Suspend orders in case of non-payment or suspected fraud.

Incorrect delivery details provided by the Customer remain the Customer’s responsibility.

If a product becomes unavailable after ordering, the Customer will be informed and may cancel the order without additional compensation.

5. Prices

Prices are indicated in euros (€) and include applicable taxes unless stated otherwise. Shipping costs are calculated separately.

The Vendor reserves the right to modify prices at any time, but products are invoiced at the rate applicable at the time of order confirmation.

International shipments may be subject to customs duties and taxes, which remain the responsibility of the Customer.

6. Payment modalities

Orders must be paid in full before processing.

Accepted payment methods may include:

  • Credit cards (Visa, Mastercard, American Express)
  • Bancontact
  • PayPal or other available payment providers

Payment is secured via encryption protocols (e.g. SSL).

The Vendor reserves the right to cancel or suspend orders in case of payment issues.

7. Delivery

Orders are shipped from Belgium within an estimated timeframe of 1 to 10 working days after payment confirmation.

Delivery times are indicative and may be affected by external factors (e.g. customs, logistics delays).

The Vendor is not responsible for delays, loss, or damage caused during transport. Goods travel at the Customer’s risk unless otherwise required by law.

Force majeure (e.g. strikes, natural disasters, supply chain disruptions) may delay or prevent delivery without liability.

8. Absence of the right of withdrawal

In accordance with Belgian law (including Article VI.53 of the Code of Economic Law), the right of withdrawal does not apply to certain goods, including perishable or customized products where applicable.

9. Intellectual property

All Website content (texts, images, logos, etc.) is protected by intellectual property rights.

Any reproduction, in whole or in part, without prior written consent is strictly prohibited.
No intellectual property rights are transferred through purchases.

10. Responsibility

Products comply with Belgian and European regulations.

The Vendor shall not be held liable for:

  • Improper use of products;
  • Individual intolerances or allergies;
  • Indirect damages (loss of profit, business interruption, etc.).

Complaints must be submitted in writing within a reasonable timeframe via email or post.
If the Vendor is at fault, it may:

  • Replace the product; or
  • Reimburse the order value.

11. Protection of Privacy

Personal data is required for order processing and is handled confidentially.

The Vendor commits to complying with applicable data protection laws (including GDPR).

Customers have the right to access, correct, or delete their data by contacting the Vendor.

12. Enforceability of the terms & conditions

Placing an order implies full acceptance of these Terms and Conditions.

If any clause is found invalid, the remaining provisions remain applicable.

The Vendor reserves the right to modify these Terms at any time. Customers are responsible for reviewing them periodically.

13. Applicable law and jurisdiction

These Terms are governed by Belgian law.

Any disputes shall fall under the jurisdiction of the courts of Ghent (Gent), Belgium, unless mandatory legal provisions dictate otherwise.
